Terms & Conditions 

OVERVIEW

This page (together with any documents referred to on it) sets out the terms and conditions on which we supply the products ("Products") listed on our website ("our site") to you. Please read these terms and conditions carefully before placing any orders. By ordering any of our Products, you agree to be bound by these terms and conditions.

You should print a copy of these terms and conditions for future reference.

By clicking buy when placing an order, you confirm your acceptance of these terms. If you do not agree to these terms, you will not be able to place an order through our site.

Our website is operated by Our Pet Village LTD ("we," "us," or "our"), registered in England and Wales with the registered office at: Pet Village, Elmstead Market, Colchester, CO7 7DZ

SECTION 1 - YOUR STATUS

By placing an order through our site, you warrant that:

1. You are legally capable of entering into binding contracts.

2. You are at least 18 years old.

SECTION 2 - HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

1. After placing an order, you will receive an e-mail from us acknowledging receipt of your order. Please note that this does not mean your order has been accepted.

2. Your order constitutes an offer to buy a Product. All orders are subject to acceptance by us, and we will confirm acceptance by sending you an e-mail that confirms dispatch of the Product ("Dispatch Confirmation").

3. The contract between us ("Contract") is only formed when we send you the Dispatch Confirmation.

4. The Contract will only relate to Products confirmed in the Dispatch Confirmation. We are not obliged to supply any other Products that may have been part of your order until their dispatch is confirmed.

SECTION 3 - CONSUMER RIGHTS

1. If you are contracting as a consumer, you may cancel a Contract within 14 days of receiving the Products. In this case, you will receive a full refund of the price paid for the Products, in accordance with our refunds policy (see Section 8).

2. To cancel a Contract, you must inform us via email using the subject line "Cancellation of Contract," quoting your order number and delivery address. Products must be returned to us within 14 days of your cancellation notice, in the same condition in which you received them. You are responsible for the cost and risk of returning the Products.

3. This provision does not affect your statutory rights.

SECTION 4 - AVAILABILITY AND DELIVERY

1. Your order will be fulfilled by the estimated delivery date set out in the Dispatch Confirmation or, if no date is specified, within 30 days of the Dispatch Confirmation, unless there are exceptional circumstances.

2. If a Product is out of stock after you place an order, we will contact you to arrange a refund or discuss alternatives.

SECTION 5 - RISK AND TITLE

1. The Products will be at your risk from the time of delivery.

2. Ownership of the Products will only pass to you when we receive full payment, including delivery charges.

SECTION 6 - PRICE AND PAYMENT

1. The price of Products will be as quoted on our site, except in cases of obvious error.

2. Prices include VAT for UK customers but exclude delivery costs, which will be added to the total amount due.

3. For international customers, additional duties and taxes may apply. These charges are your responsibility.

4. Payments must be made by credit or debit card at the time of order. Your card will be charged immediately upon order confirmation.

SECTION 7 - REFUNDS POLICY

1. If you cancel a Contract within the 14-day cooling-off period, we will process your refund within 14 days of receiving the returned Products. You will be responsible for the cost of returning the item.

2. For defective Products, we will examine the returned Product and notify you of your refund via email within a reasonable period. Refunds for defective Products include delivery charges and reasonable return shipping costs.

SECTION 8 - OUR LIABILITY

1. We warrant that Products purchased through our site are of satisfactory quality and fit for their intended purpose.

2. Our liability for losses is limited to the purchase price of the Product. We are not responsible for indirect losses, such as loss of income or business, arising from your use of our Products.

3. This does not exclude or limit our liability for death or personal injury caused by our negligence, fraud, or other liabilities that cannot be excluded by law.

SECTION 9 - IMPORT DUTY

If you order Products for delivery outside the UK, you are responsible for import duties, taxes, and compliance with local laws.

SECTION 10 - WRITTEN COMMUNICATIONS

By using our site, you agree to electronic communication. For contractual purposes, you consent to receive communications electronically and agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement for written communication.

SECTION 11 - NOTICES

All notices to us should be sent to hello@ourpetvillage.com. Notices to you will be sent to the email or postal address provided when placing an order.

SECTION 12 - EVENTS OUTSIDE OUR CONTROL

We are not liable for delays or failures to perform obligations due to events outside our reasonable control ("Force Majeure"). This includes acts of God, strikes, wars, natural disasters, and disruptions to telecommunications or transportation.

SECTION 13 - ENTIRE AGREEMENT

These terms and any document referred to constitute the entire agreement between you and us regarding the sale of Products.

SECTION 14 - LAW AND JURISDICTION

Contracts for the purchase of Products through our site are governed by English law. Any disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales.
